“THE ASHLEY FURNITURE HOMESTORE ROOM MAKEOVER CONTEST”
OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN
(1) ELIGIBILITY:
KBAK-29 The Eyewitness News Station and KBFX-Fox58 “The Ashley Furniture HomeStore Furniture Makeover” (the “Contest”) is open only to legal residents of California, 18 years of age or older at the time of entry residing in the county of Kern County. Employees of KBAK, KBFX, UPick-Em and Ashley Furniture HomeStore (the “Sponsors”), their affiliates, subsidiaries, franchisees, representatives, advertising agencies and their immediate family members are ineligible to participate in the Contest. This Contest is void where prohibited by law.
(2) HOW TO ENTER AND PLAY:
-- (a) Beginning on August 18, 2008, and ending at 8:00pm September 1, 2008 (the “Contest Submission Period”) Entrants can participate in the Contest by submitting a completed entry form (“Entry”) at KBAK’s/KBFX's website located at "Inside Eyewitness" on www.BakersfieldNow.com the website or at Ashley Furniture Homestore, 8915 Rosedale Highway, Bakersfield, CA 93312 each participant (“Entrant”) must complete and submit an entry form, including his/her first and last names, age, complete address (including street address, city and ZIP code), telephone number where he/she can be reached, and e-mail address. Entrants may begin submitting entries starting at approximately 7:00 a.m. P.S.T on August 18, 2008. All Entries must be received no later than 8:00 p.m. P.S.T. on September 1, 2008 in order to be eligible for the Contest. All Entries are the property of KBAK/KBFX & Ashley Furniture HomeStore and will not be returned.
-- (b) On or about September 2, 2008 KBAK/KBFX & Ashley Furniture HomeStore will select three Finalists from all complete and eligible Entries received during the Contest Period. The three Finalists will be featured on Eyewitness News on KBFX (FOX58) on Wednesday Morning between 7:00am and 9:00am, September 3rd.
-- (c) Beginning September 3, 2008 and ending at 12:00pm on September 7th the public will be encouraged to log onto "Inside Eyewitness" on www.BakersfieldNow.com and vote for their favorite Furniture Makeover finalist. On or about September 7, 2008 KBAK/KBFX will announce the Prize Winner thereafter notify the Prize Winner by telephone and/or email. KBAK/KBFX & Ashley Furniture HomeStore will make no more than two (2) attempts to notify the Winner. If the Winner does not respond to KBAK/KBFX & Ashley Furniture HomeStore’s notification within 72 hours of notification, KBAK/KBFX & Ashley Furniture HomeStore, in its sole discretion, may disqualify the Winner and may or may not select an alternate Winner from the remaining eligible and complete Entries.
(3) PRIZE:
One Winner will receive the following Prize: A gift certificate to Ashley Furniture HomeStores in the amount of two thousand five hundred dollars ($2500.00) to be used for purchase and/or installation of furniture purchased at Ashley Furniture HomeStore, 8915 Rosedale Highway, Bakersfield, CA 93312
The total approximate retail value of the Prize is $2,500.00. No substitutions are allowed, except that the Sponsors may, in their sole discretion, substitute a prize of equal or greater value.
The Winner may waive his/her right to receive the Prize; however, the Prize is non-assignable, nontransferable, and not redeemable for cash or credit, and will not be replaced if lost or stolen. The Winner is responsible for all expenses, costs and fees not explicitly listed as part of the Prize. All fees and reporting requirements associated with federal, state and local taxes are the sole responsibility of the Winner. Pursuant to federal law, Ashley Furniture HomeStore will issue a 1099 Form to the recipient of any Prize. Ashley Furniture HomeStore will also send a publicity release, indemnification and affidavit of eligibility to the Winner. By accepting any Prize, the Winner agrees to complete, sign and return these documents no later than ten (10) days after receipt of the above-mentioned documents. Failure to sign and return the release, indemnification and affidavit may, at the sole discretion of KBAK/KBFX & Ashley Furniture HomeStore, result in the Winner’s disqualification and the award of the Prize to an alternate Winner.
(4) ODDS:
The odds of winning depend on the number of complete, eligible Entries received.
(5) PARTICIPATION:
Participation in this Contest constitutes an agreement by each Entrant to comply with all terms, provisions and conditions of these Official Rules. Entrants further agree to be bound by the terms relating to the use of KBAK/KBFX's website, including its Privacy Policy. Entrants also authorize the Sponsors to use their name, voice, likeness, biographical data and city of residence in programming or promotional material without further compensation, unless prohibited by law. The Sponsors reserve the right to disqualify Entrants found tampering with or otherwise abusing any aspect of this Contest as solely determined by the Sponsors.
(6) SPONSORS’ RESERVATION OF RIGHTS:
If for any reason the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the Sponsors’ control that affect the administration, security, fairness, integrity or proper conduct of the Contest, KBAK/KBFX & Ashley Furniture HomeStore reserves the right, in its sole discretion, to modify, cancel, suspend or terminate the Contest.
(7) DISCLAIMER AND RELEASE:
By entering into the Contest or accepting or using any prize award or benefits, each Entrant releases the Sponsors and each of their affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of the Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). The Sponsors disclaim any liability for: (1) any error, omission, interruption, deletion, defect, delay or failure in the transmission of Entries or the operation of the Contest; (2) any theft, destruction or unauthorized access to or alteration of Entries; (3) any problems or technical malfunctions of any computer hardware, software, networks, lines, online systems, providers or servers associated with or used for the Contest, whether originating from Entrants, Sponsors or others; (4) failure of any Entry to be received by the Entry Deadline on account of traffic congestion or technical problems on the Internet or at any website, or any combination thereof; (5) any incomplete, inaccurate, illegible, garbled, defective, misdirected or misrouted Entries; (6) any injury or damage to any computer related to or resulting from participation in or downloading any materials for this Contest; or (7) any disputes, claims, damages, fees, costs, injuries or damages associated with or involving the use of the Prize.
(8) CONSTRUCTION:
All questions, issues, claims and disputes concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any Entrant, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than California.
(9) SPONSORS:
The Contest is sponsored by KBAK - 29 The Eyewitness News Station, KBFX-FOX58 and Ashley Furniture HomeStore. The Sponsors’ decisions regarding the selection of the Winners and all other aspects of the Contest shall be final and binding in all respects. The Sponsors will not be responsible for any typographical, printing or other inadvertent errors in these Official Contest Rules or any other materials or administration relating to the Contest.
