KBAK/KBFX – HOT TIMES CONTEST OFFICIAL RULES.

KBAK/KBFX Television stations and Econo-Air Air Conditioning (referred to as SPONSORS from this point) are giving viewers a chance to enter the HOT TIMES contest in an effort to win a new American Outdoor Grill, model #36PC. The contest will begin May 8, 2013 and end at Noon on May 29, 2013.

NO PURCHASE NECESSARY TO ENTER OR WIN: Entrants will submit electronically to Bakersfieldnow.com the date and time they believe Bakersfield will reach 100 degrees for the first time this year as recorded by Meadows Field in Kern County. There is no other method of entry. Only one entry is allowed per person and the entry must be received by Noon May 29,2013 PDT to be eligible. SPONSORS are not responsible for any losses, damage or liabilities resulting from technical malfunctions or for submissions, entries, claims or notices that are late, lost, misdirected, damaged, illegible, incorrect, or incomplete.

ENTRY:  Entries will be accepted from May 8, 2013 through Noon  on May 29, 2013. In the event the temperature reaches 100 degrees prior to the deadline any entries received within 24 hours prior to the temperature reaching 100 degrees will not be considered.

PRIZE DETAILS: One Grand Prize Winner will be awarded an American Outdoor Grill, model #36PC.  Retail Value: $3,000.
No cash prize will be awarded.  

AWARDING PRIZES: Contestants will be judged soley by the date and time submitted as their guess of when Bakersfield will reach 100 degrees for the first time this year as recorded by Meadows Field in Kern County. Decisions and interpretations of these rules are final in all matters relating to this contest. Winners will be notified that they have won within 48 hours of the contest ending. Winner will be required to complete and return an affidavit of eligibility, liability/publicity release or the prize will be forfeited. In the liability release, the winner will agree to indemnify and hold harmless SPONSORS and its agents for any injuries, damages or losses which may be sustained in connection with the ownership, use or misuse of any prize. Prizes may not be awarded if a selected winner is determined to be ineligible. In order to receive a prize, a winner is not required to purchase goods or services, pay any money or submit to any sales presentation. ALL PRIZES ARE AWARDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR OF MERCHANTABILITY.

ODDS OF WINNING: Odds of winning depend on the number of entries.

ELIGIBILITY: Void where prohibited by law. KBAK/KBFX, Econo Air employees and their family members and/or those living in the household of the same are not eligible. Offer void where prohibited, and subject to all federal, state and local laws and regulations. Entrant must be over the age of 18 and a United States Citize and reside in the viewing area of KBAK/KBFX Television Stations, located in Bakersfield, California.

AS A CONDITION OF ENTERING THIS CONTEST, PARTICIPANT(S) AGREE THAT: (1) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR ANY LOSSES OR DAMAGES AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE DAMAGES, INCIDENTAL, SPECIAL AND CONSEQUENTIAL DAMAGES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES; (2) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST, OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION; AND (3) ANY AND ALL CLAIMS, JUDGMENT AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST BUT IN NO EVENT ATTORNEYS' FEES. SPONSORS CAN NOT BE HELD LIABLE FOR ANY HARDSHIP OR LOSS OF ANY KIND IN ANY FORM.

USE OF INFORMATION: Entry constitutes permission to use winner's names and likeness for publicity purposes without further compensation (except where prohibited by law) and for sponsor's compliance with federal, state and local laws and regulations.
 

RELEASE OF LIABILITY. SPONSORS and their affiliated companies and their respective officers, directors and employees shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and /or causes of actions which arise out of and/or are in any way related to the prize(s), the receipt, use and/or enjoyment of the prize(s) and/or damages or losses related to the contest. If a Sponsor pulls out of a contest for reasons beyond SPONSORS control, SPONSORS are not responsible for continuing the contest and may substitute prizes to fulfill obligations.

IDENTIFICATION OF PARTICIPANTS/USE OF PICTURE AND LIKENESS: Entrants understand that by submitting an entry they may be called by SPONSORS personnel live on-the-air, or taped live-on-the-air for use as part of the contest or in future advertising or promotion on any SPONSOR marketing platform. Entrants further understand that permission to use their voice, likeness and/or name is granted by entering to win this contest. By entering, entrants consent to such use. Each winner further grants SPONSORS and its affiliates full permission and authority to use his or her name, likeness and/or voice in all forms of advertising or promotion without further compensation or permission.

PROBLEMS WITH ENTRIES IN ALL CONTESTS; SPONSORS NOT RESPONSIBLE: SPONSORS are not responsible for any malfunction of computer or phone equipment. No liability is assumed by the SPONSORS for any malfunction of the internet, individual computer systems or phone lines. SPONSORS (i) disclaims and assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission of entries by any and all methods; communications line, device, or system failure; theft or destruction or unauthorized access to, or alteration of, entries; faulty, mis-transcribed, misdirected, failed, incomplete, garbled entries; misdialed communications or transmission; (ii) is not responsible for any problems or technical malfunction of any telephone, communications, or wireless network or lines, computer on-line systems, servers, internet service provider, computer or handheld device, equipment, hardware, software, failure of any entry information to be received by the Sponsor on account of technical problems, human error, or traffic congestion on the Internet, at any website, or wireless network, and (iii) is not responsible for any combination of the above, including any injury or damage to the participant's or any other person's computer or other hardware or equipment related to or resulting from entering, participation in, or downloading any materials in this contest.

Determination of Winner(s). Contestants will be judged soley by the date and time submitted as their guess of when Bakersfield will reach 100 degrees for the first time this year as recorded by Meadows Field in Kern County. Decisions and interpretations of these rules are final in all matters relating to this contest.  Any and all decisions are final. Contest rules are available by request from KBAK/ KBFX, Promotions Department. Any person requesting contest rules must send a self-addressed envelope to “ATTN: Promotions: “Hot Times Contest Rules to: 1901 Westwind Drive, Bakersfield, CA 93301 or go on-line to the contest page on BakersfieldNow.com. For a list of winners, send a self-addressed, stamped envelope to “ATTN: Promotions: “Hot Times Contest Winners” to 1901 Westwind Drive, Bakersfield, CA 93301” within 30 days of the conclusion of the contest. SPONSORS are only required to provide the first name and last initial of winner as well as they city he/she resides in upon valid request.

If the contest is postponed, cancelled or for other reasons, beyond our control, does not occur/exist, Sponsors will not be responsible for replacing the prize.

In accepting a prize, the winners accept to take the prize as outlined in the contest. If a winner is not able,or chooses not to accept prize “as is” within 30 days of the contests' end, winner forfeits his/her prize, and SPONSORS reserve the right to select another winner. Winners are responsible for all costs associated with prize that was awarded, unless otherwise specified.

Requirements for Claiming Prize(s). Winner is required to complete Affidavit of Eligibility and Release Forms before prize will be awarded. If winner is under the age of 18, a parent or legal guardian must sign the release form on behalf of the winner and/or their guest. SPONSORS are not responsible for prizes that are lost, stolen, misdirected, or damaged.

Taxes and Expenses. The winner (or parent or legal guardian of the winner if the winner is under the age of 18) agrees to pay all expenses, taxes & fees not included in the prize. SPONSORS will report to the Internal Revenue Service any winnings totaling over $600 (in cash or fair market value) during the calendar year. Winners will receive an IRS 1099 Tax form if any winnings are reported. Winners are responsible for payment of all taxes on prize(s).

Amendments to Rules/Severability. SPONSORS reserve the right to amend the contest dates and rules at any time. If any portion of the above rules is determined to be unenforceable due to local or state laws, all other portions of these official rules remain in effect.

Postponement or Cancellation of Contest. Due to news events of the day, or any reason beyond Sponsor’s control, Sponsors reserve the right to post-pone or cancel a contest without notice. If, for any reason, the contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or any other causes beyond the control of SPONSORS which corrupt or affect the administration, security, fairness, integrity of the contest, SPONSORS reserves the right in its discretion to disqualify any individual it believes has tampered with the entry process, and/or cancel, terminate, modify or suspend the contest. SPONSORS reserve the right to select winners from eligible entries received as of the termination date.
